Welcome to Safe Plate! These Terms of Use ("Terms") govern your access to and use of the Safe Plate mobile application ("App") and website ("Website").

By accessing or using the App or Website, you agree to be bound by these Terms. If you do not agree to these Terms, you must refrain from using Safe Plate.

1. General Use of Safe Plate

Safe Plate is designed as an informational tool to assist users in communicating their dietary restrictions and allergies in multiple languages. The App does not replace:

• Medical advice
• Professional dietary consultations
• Direct communication with food service providers

Users should always verify food-related information directly with restaurants or food providers.

2. Menu X-Ray Feature

Safe Plate includes the Menu X-Ray feature, which allows users to scan and analyze restaurant menus using AI-powered technology. This feature accepts menu input via:

• Photos taken with your device camera
• Images from your photo library
• PDF documents
• URLs to online menus

The Menu X-Ray feature uses artificial intelligence and machine learning models provided by third-party services (including Anthropic, Mistral AI, and Google) to extract text from menu images, identify menu items, detect potential allergens, and assess dietary compatibility based on your profile.

Important limitations of Menu X-Ray:

• AI results are not guaranteed: The accuracy of ingredient detection, allergen identification, and dietary assessments depends on image quality, menu formatting, and AI model capabilities. Results may be incomplete or incorrect.
• Not a substitute for verification: You must always verify AI-detected ingredients and allergens directly with restaurant staff before consuming any food.
• Not medical advice: Menu X-Ray does not provide medical diagnoses or treatment recommendations. It is an informational tool only.
• Language limitations: While Menu X-Ray supports multiple languages, translations and interpretations may contain errors.

3. No Liability for Misuse or Errors

Safe Plate does not guarantee the accuracy, completeness, or reliability of its translations, dietary categorizations, AI-generated analysis, or any other information provided. Users assume full responsibility for verifying the accuracy of all dietary details before consuming food.

By using Safe Plate, you expressly acknowledge and agree that:

• Safe Plate does not provide medical, nutritional, or legal advice.
• Safe Plate is not responsible for any health-related incidents, allergic reactions, or cross-contamination issues.
• You must verify all food details with restaurant staff or food providers before consuming food.
• AI-powered features including Menu X-Ray may produce inaccurate, incomplete, or misleading results.
• Safe Plate shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from reliance on the App, including but not limited to:
  • Misinterpretations
  • Incorrect translations
  • Inaccurate food information
  • AI-generated errors in ingredient or allergen detection
  • Failures in menu scanning or text extraction

Use of Safe Plate is at your own risk.

4. No Guarantee of Language Accuracy

Safe Plate supports translations in 32+ languages. However, language variations, regional dialects, and cultural differences may lead to errors or misinterpretations. Safe Plate cannot be held responsible for misunderstandings due to translation inaccuracies.

5. User Responsibility

By using Safe Plate, you agree that:

• You are solely responsible for how you use and present the information provided by the App.
• You must always confirm with restaurant staff or food providers to ensure they fully understand your dietary restrictions.
• Safe Plate does not replace direct verbal communication with restaurant staff.
• When using Menu X-Ray, you must verify all AI-detected ingredients and allergens with restaurant staff before making food choices.

6. Limitation of Liability

To the fullest extent permitted by law, Safe Plate, its developers, affiliates, and licensors shall not be liable for any claims, damages, losses, or liabilities arising from the use or misuse of the App, including but not limited to:

• Personal injury or allergic reactions caused by incorrect or incomplete dietary information.
• Translation errors resulting in misunderstandings regarding food ingredients or preparation.
• AI processing errors in Menu X-Ray resulting in incorrect ingredient detection, missed allergens, or inaccurate dietary assessments.
• Any loss, damage, or legal disputes resulting from reliance on the App's content.

Safe Plate is provided "as is" and "as available", without warranties of any kind, whether express or implied. Users acknowledge that they use Safe Plate entirely at their own risk.

7. Indemnification

By using Safe Plate, you agree to indemnify, defend, and hold harmless Safe Plate, its developers, affiliates, officers, employees, and licensors from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with:

• Your use or misuse of the App.
• Any reliance on the information provided by Safe Plate, including AI-generated content.
• Your failure to verify dietary information before consuming food.
• Any third-party claims related to your use of Safe Plate.

8. Force Majeure

Safe Plate shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, cyberattacks, technical failures, labor strikes, governmental actions, or legal restrictions.

9. No Liability for Third-Party Actions

Safe Plate is not responsible for the actions, omissions, or policies of third parties, including but not limited to:

• Restaurant staff, food service providers, or any other individuals interpreting your dietary information.
• Third-party AI providers (Anthropic, Mistral AI, Google) used for menu analysis and text processing.
• Third-party translation providers, AI language tools, or external databases.
• App store platforms (e.g., Apple App Store, Google Play) regarding downloads, payments, or app availability.

Safe Plate does not endorse, guarantee, or assume responsibility for any third-party services linked or referenced within the App.

10. Changes to These Terms

We reserve the right to modify or update these Terms at any time. Any changes will be posted on this page. Continued use of Safe Plate after modifications constitutes acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by and construed under Dutch law, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

By using Safe Plate, you expressly waive any right to claim protection under the laws of any other jurisdiction.

12. Global Applicability and Language

• These Terms of Use apply to all users worldwide, regardless of location.
• The English version of these Terms shall be the legally binding version in case of any discrepancies between translations in different languages.
• Safe Plate does not guarantee the accuracy of any translated versions of these Terms.
